Bell Terms of Service
1. Who provides Bell
Bell is operated by Tom Yehuda Bar Haim, an Israeli registered sole proprietor (עוסק מורשה), trading as TBH Advisory ("we", "us"). Contact: tom@tbh-advisory.com.
2. What Bell is
Bell is an operations assistant for insurance agencies. An agency connects Bell to its own client system and to its WhatsApp Business account, and Bell then tracks the unfinished work that follows an instruction from the agency's staff: for example, asking a client for documents, reminding the client, and recording what arrived. Bell acts on the agency's behalf. It is not a service for consumers, and consumers do not sign up to it.
These terms apply to every agency that uses Bell (the "Agency") and to the people the Agency authorises to use it.
3. Connecting WhatsApp
The Agency connects its WhatsApp Business account to Bell through Meta's Embedded Signup, which authorises Bell, as a technology provider, to send and receive WhatsApp messages on the Agency's behalf. Bell keeps the access token Meta issues for that purpose encrypted, and uses it only to provide Bell to that Agency. The Agency can disconnect its account from Bell at any time, from its WhatsApp Business app or its Meta business settings. We delete the stored token with the Agency's other operational data when its use of Bell ends.
4. The Agency's responsibilities
The Agency is responsible for:
(a) having any lawful basis, notice or consent required by applicable law and applicable WhatsApp policies for processing client information and contacting clients through Bell;
(b) the accuracy of the information in its own client system, which Bell reads at the moment a question is asked;
(c) the messages Bell sends to its clients. Bell sends the first message of each request only after a person at the Agency has approved it. Where the Agency has switched reminders on, Bell sends follow-up reminders automatically, three days apart and at most two for each request, and stops once the requested file has arrived;
(d) complying with the WhatsApp Business terms and policies that apply to its account;
(e) keeping its sign-in links and devices secure and telling us promptly if it believes they have been misused.
5. WhatsApp and Meta
Bell uses the WhatsApp Business Platform, operated by Meta. Meta's own terms and policies apply to the Agency's use of WhatsApp, and Meta, not Bell, decides whether a WhatsApp account, number or message template is approved, limited or suspended. If Meta restricts, suspends or changes the platform, the parts of Bell that depend on it may stop working.
6. Acceptable use
The Agency may not use Bell to send marketing or bulk messages, to contact people who are not its clients, to send unlawful, misleading or abusive content, to try to reach another agency's information, or to probe, overload or work around Bell's security controls.
7. Information and confidentiality
How Bell handles information is described in the Privacy Policy at https://bell.bari.digital/privacy. In short: the Agency decides what information is processed and why, and we process it on the Agency's instructions to provide Bell. We keep the Agency's information confidential and do not use it for any other purpose. Until a data processing agreement between the Agency and us is in force, Bell does not read the Agency's client system, does not store documents forwarded to it, and does not connect the Agency's WhatsApp account, and the Agency's staff should not type client information into Bell. Bell's database is hosted by Render in the European Union, and Bell applies technical access controls designed to separate each Agency's information from information belonging to other agencies. To interpret an instruction, Bell sends the message and the results of any lookup it performed to a language model operated by Google. Before it does, Bell replaces phone numbers, identity and other long numbers, and email addresses with placeholders; names and the rest of the text are sent as written. Bell uses Google's paid service, under whose terms Google does not use this information to improve its products. WhatsApp messages pass through Meta. Google and Meta may process information outside Israel and outside the European Union. We will tell the Agency promptly, and in any case within 72 hours, after becoming aware of an actual or reasonably suspected security incident affecting the Agency's information held by Bell, and immediately where the incident appears to be a serious incident as the Privacy Protection (Data Security) Regulations, 5777-2017, define it. Our first notice gives the facts then known and says whether the incident is suspected or confirmed, and we update it as facts are established.
8. Availability
Bell is provided as it is and as it is available. It is in early operation, and we do not promise any particular uptime. It depends on services we do not control, including Meta, the Agency's own systems, our hosting provider and a language model provider, and any of them can interrupt it. Bell helps the Agency's staff; it does not replace their judgement, and the Agency remains responsible for checking the work it approves.
9. Suspension and termination
The Agency may end its use of Bell at any time by written notice to us. We may end the Agency's use of Bell with 14 days' written notice. We may suspend or end the Agency's use of Bell immediately where Meta requires it, where the Agency materially breaches these terms, or where it is needed to protect Bell, another agency or the security of information.
After termination, the Agency may ask us for an export of its information held by Bell, which we prepare by hand in a readable format. Within 30 days after termination we delete the Agency's information from Bell's active systems. Copies in our hosting provider's backups are not deleted individually: they expire on the provider's schedule (currently within seven days), and we restore them only to recover from a disaster. We may keep information where the law requires it and security and audit records. Anything we keep remains protected and is not used for any other purpose, and our confirmation of deletion says separately what was deleted and what will expire.
10. Liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for loss caused by a service we do not control, and our total liability to an Agency is limited to the greater of the fees paid for Bell during the twelve months before the claim and ILS 20,000. This limit does not apply to loss caused by our wilful misconduct or gross negligence, or to any liability that the law does not allow to be limited.
11. Fees
Fees, if any, are set in a separate agreement between the Agency and us.
12. Changes
We may update these terms. We will tell each Agency by email at least 14 days before a material change takes effect, and an Agency that does not accept the change may stop using Bell before it applies.
13. Law
These terms are governed by the laws of the State of Israel, and the competent courts in Tel Aviv-Jaffa have exclusive jurisdiction.
